A BYLAW OF THE TOWN OF ROCKGLEN TO PROVIDE FOR THE COLLECTION AND DISPOSAL OF DOMESTIC WASTE AND OTHER REFUSE.
The Council of the Town of Rockglen in the Province of Saskatchewan enacts as follows:
This bylaw may be cited as the Waste Management Bylaw.
(a) “Bag and Tag Program” means the waste material collection system, where users are required to prepay for tags and fasten the tags to their bags of garbage or waste items to have waste material removed by the Town.
“Compost Material” means garden waste, grass clippings, leaves, twigs, fruit, vegetables and other vegetative matter, but does not include branches, trees or household waste.
“Household Waste” means food scrapes, packaging and general household waste that cannot be recycled and is not considered hazardous to the environment.
“Designated Areas: means separate sites within the waste disposal ground set aside for particular disposal ex: domestic waste and rubbish; electronics and paint; untreated wood/branches; and white metal.
“Council” means the Council of the Town of Rockglen.
“Municipality” means the Town of Rockglen.
“Virgin Wood” means branches, trees, lumber scraps, or any other wood product that is still in an untreated or unprocessed form or is considered to be in its basic natural wood form.
“White Metal” means appliances, water heaters and softeners, furnaces and similar house hold equipment.
“Freon Removal Sticker” means a designated municipal sticker issued by the Town for the purpose of having the Freon removed by an authorized dealer.
“Electronics” means all household items such as computers, stereos, video cassette recorder (VCR), televisions, etc. that can be taken to SARCAN for recycling.
“Rubble” means broken cement, pavement rock, bricks, asphalt shingles or similar items.
“Hazardous Waste” means oil, fuels, lubricants, antifreeze, oil base paints, solvent cleaners, herbicides, pesticides, insecticides, noxious chemicals, containers for herbicides, pesticides, insecticides, noxious chemicals and other material or element that is considered harmful to the environment. Soil, or material contaminated with any of the above, also considered hazardous waste.
“Tag” means a designated municipal tag issued by the Town for the purpose of the Bag and Tag Program.
“Public Highway” means a road allowance or a road, street or lane, vested in Her Majesty or set aside for such purposes and includes the entry road to the waste disposal ground, a bridge, culvert, drain or other public improvement erected upon or in connection with such public highway.
“Waste Disposal Ground” means the municipal waste disposal site located on SW 2-3-30 W2nd.
Residents of the Town are encouraged to remove all recyclables, accepted by LORAAS Disposal, from their waste stream and deposit them in the Bin Blue Bin provided.
All residential receptacles, plastic bags, or items of waste to be removed by the Town shall have a tag affixed to them in a clearly recognizable manner. The tags shall be purchased in advance from the Town at a cost as established by Council.
Businesses that pay a yearly fee for waste collection to the Town, as established by Council, are not required to affix tags to their refuse. Businesses that do not pay the yearly fee to the Town are required to affix tags to their refuse. The tags shall be purchased in advance from the Town at a cost as established by Council.
Maximum size for all receptacles, plastic bags or items of waste shall be 77 litres.
Maximum weight for all receptacles, plastic bags or items of waste shall be 40 pounds.
The Town shall provide garbage service to each residential property.
The Town shall provide garbage service to each commercial property.
All receptacles, plastic bags, or items of waste shall be placed on the front street on the day of pick-up no later than 8:00 a.m.
The Town reserves the right to refuse to collect for removal any of the following waste:
(I) any receptacle, plastic bag, or waste item that does not have a tag affixed to it as required under Section 4.
(ii) any receptacle, plastic bag or waste item that is considered over-sized or overweight.
(iii) any hazardous waste item.
(iv) any waste material or item not accepted at the Rockglen Landfill Site.
(v) any other waste material or item that could be considered unsuitable for collection.
Any waste, once collected by the Town, is considered sole property of the Town to do with as seen fit. The Town reserves the right to return, to the original owner, any waste that is later determined to be hazardous or inappropriate for handling by the Town or to recover costs from the owner for its proper disposal.
No person shall litter in any public place or private property within the Town.
No person shall litter or deposit waste at or near the gates of the Rockglen Landfill Site or at or on the roadway leading to the Rockglen Landfill Site.
No person shall deposit or allow to be deposited any waste, liquid wastes, automobile or equipment fluids or hazardous wastes on or in any street, lane or public place.
No person shall deposit or allow to be deposited any materials associated with the construction, repair or demolition of buildings on or in any street, lane or public place.
No person shall deposit or pile or allow to be deposited or piled any materials associated with landscaping on or in any street, lane or public place. Such materials shall include, but are not limited to, lumber, dirt, bricks and gravel.
No owner, occupant or person in charge of a construction site shall allow the site or areas adjacent thereto to become or remain untidy or unsightly and shall provide and maintain, in good condition, a sufficient number of covered waste receptacles for the placement of any waste produced as a result of such construction site and shall periodically ensure the disposal of such waste in the manner provided in this Bylaw.
No person shall deface, destroy or alter any signs, gates or fencing at the Rockglen Landfill Site.
Hours of operation shall be set by resolution of Council and posted at the Town Office and the Rockglen Landfill Site.
The gates to the Rockglen Landfill Site shall be locked except during the designated hours of operation.
Unauthorized persons trespassing or making use of the Rockglen Landfill Site after designated hours of operation is strictly prohibited.
The Town shall ensure that the Rockglen Landfill Site is supervised during the designated hours of operation and no one will be allowed into the Rockglen Landfill Site without supervision.
The Rockglen Landfill Site shall be segregated in order that different types of waste can be placed in separate areas. The supervisor shall ensure that all users of the Rockglen Landfill Site deposit their waste materials in the appropriate areas.
No person shall remove, disturb, or take away any material, object or thing from the Rockglen Landfill Site without written permission from council. The Municipality shall own and have the sole right to dispose of all refuse collected and delivered to the Rockglen Landfill Site.
Manure, grain, bales, petroleum wastes, slaughter house wastes, dead animals, propane tanks, fuel tanks, batteries and other comparable wastes shall not be deposited at the Rockglen Landfill Site.
No person shall operate any vehicle transporting domestic waste, refuse or rubbish over any public highway unless the load is completely enclosed or covered with a tarpaulin or secured in such a manner that it shall be impossible for any part of the said vehicles load to escape.
All receptacles, plastic bags, or items of waste shall be securely placed in a proper waste receptacle.

29. No person shall permit or allow waste stored or set out for Town waste service to:
create offensive odours;
be windblown; or
Council may order an owner or occupant of property in the town to obtain or provide a proper waste receptacle and, if that person fails to comply with the order within the specified time set out in the order, Council may provide such receptacle at the expense of that person.
The burning of any waste material is strictly prohibited within Town limits.
Absolutely no burning is allowed at the waste disposal ground unless carried out by the Municipality or its representative.
Every owner or occupant shall ensure that the waste be placed in front of the designated property where the waste was generated.
Electronic items allowed in the trailer located at the Rockglen Landfill Site are as follows:
- desktop computers
- portable computerscomputer peripherals (keyboards, mice and
- desktop printers and fax machinestv’s and computer monitors
- personal or portable audio/video systemsvehicle audio/video systems
- home theatre in-a-box systemshome audio/video systems
- non-cellular telephones
Electronic items not allowed in the trailer located at the Rockglen Landfill Site are as follows:
- small appliances such as toasters, toaster ovens, blenders, etc.
All appliances containing Freon must have a Freon Removal Sticker attached to it before the appliance will be accepted at the Rockglen Landfill Site. The Freon Removal Sticker shall be purchased in advance from the Town Office.
The Town shall charge the rates as set out in Schedule “A”.
Any person who contravenes any of the provisions of this Bylaw is guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw of the municipality.
Bylaw No. 10-97 be hereby repealed.
COMING INTO FORCE
This Bylaw shall come into force and take effect February 1, 2016.
